This Agreement governs your use of the services provided by Aquasition IO LLC, operating as Britehome ("Britehome," "we," "us," or "our") at britehome.com. By engaging our services, completing our onboarding form, or submitting payment, you ("Client") agree to be bound by this Agreement in full.
01Services
Britehome provides pay-per-lead SMS marketing services to residential contractors in the home services industry, including but not limited to pool construction and renovation, turf installation, painting, landscaping, and hardscaping. Our services include outbound SMS campaign management, lead generation, and ongoing campaign optimization performed on the Client's behalf.
02Campaign Registration & EIN Authorization
By submitting your Employer Identification Number (EIN) through our onboarding process, you expressly authorize Britehome to register and operate SMS marketing campaigns on behalf of your business using your EIN and business identity. You represent and warrant that: (a) you are authorized to provide this EIN; (b) the EIN belongs to a legally registered business entity; and (c) your business is in good standing in its state of registration. Britehome will use your EIN exclusively to register 10DLC SMS campaigns in connection with the services we provide to you.
03TCPA Compliance & Client Liability
Client acknowledges that SMS marketing campaigns may be subject to the Telephone Consumer Protection Act (TCPA), state-equivalent laws, and applicable carrier regulations. Client is solely responsible for ensuring that the campaigns operated on its behalf comply with all federal, state, and local laws governing outbound communications in Client's service areas. Client agrees to indemnify, defend, and hold harmless Britehome, its owners, employees, and agents from and against any claims, damages, fines, penalties, or legal fees arising out of or related to TCPA claims, regulatory actions, or consumer complaints connected to campaigns run on Client's behalf using Client's business identity and EIN.
04Lead Delivery
Britehome will use commercially reasonable efforts to begin delivering leads within 1–7 business days of campaign launch. Lead volume and timing may vary depending on campaign targeting, market conditions, carrier performance, and other factors outside our control. Britehome does not guarantee a specific number of leads within any given timeframe beyond what is set out in the Client's agreed lead package.
05Lead Quality & Credits
Britehome is committed to delivering qualified leads — homeowners who have expressed interest in the Client's services. Lead credits may be requested under the following conditions:
- The credit request must be submitted within 7 days of the lead's delivery.
- Client must provide documented evidence that the homeowner did not respond after at least three contact attempts, or that the homeowner explicitly stated they are not interested.
- Credits are issued at Britehome's sole discretion after reviewing the documentation provided. Submitting a request does not guarantee approval.
Approved credits are applied to future lead packages on the Client's account and are not redeemable for cash.
06Payment
All sales are final. Payment is due at the time of purchase or as otherwise agreed in writing. Britehome accepts payment through approved payment methods. Declined or failed payments may result in paused or terminated campaigns. Client is responsible for keeping payment information current and valid.
07Refunds
All sales are final, and no refunds will be issued except as follows: if no leads have been delivered within 14 calendar days of campaign launch, Client may submit a written refund request to [email protected]. Refund eligibility is subject to our review and is issued solely at Britehome's discretion. Approved refunds are processed within 10 business days. Full details are set out in our Refund Policy.
08Limitation of Liability
To the fullest extent permitted by law, Britehome's total liability to Client for any claim arising out of or related to this Agreement will not exceed the total amount Client paid to Britehome in the 30 days preceding the claim. Britehome will not be liable for any indirect, incidental, consequential, or punitive damages.
09Termination
Either party may terminate services with written notice. On termination, any outstanding leads in active campaigns will continue to be delivered through the end of the current campaign cycle. No refunds will be issued for unused portions of a lead package except as set out in Section 7.
10Governing Law
This Agreement is governed by the laws of the State of [STATE OF FORMATION], without regard to its conflict-of-law provisions. Any disputes will be resolved in the courts of that state.
11Entire Agreement
This Agreement, together with the Refund Policy and Privacy Policy available at britehome.com, makes up the entire agreement between the parties and supersedes all prior discussions, representations, or agreements. Britehome reserves the right to update these terms at any time. Continued use of services following notice of changes constitutes acceptance.
